TimerDash by BananaSkinz - Terms of Use

Introduction
Welcome to TimerDash (the "App"), a timer and stopwatch application built with a focus on user privacy and simplicity. The App is operated by Bidit Mazumder (also known as BananaSkinz) ("we," "us," or "our"). By downloading or using TimerDash, you agree to these Terms of Use, so please read them carefully. If you do not agree with these terms, you should not use the App. This agreement is between you and Bidit Mazumder (referred to as "we", "us", or "Developer"), the developer and copyright owner of TimerDash. These Terms explain your rights and responsibilities when using TimerDash. Please also review our Privacy Policy to understand how we handle your personal data. This Privacy Policy is also available via the link labeled "Privacy Policy" in the App's About screen. Using TimerDash means you accept both these Terms and our Privacy Policy.
License to Use the App
We grant you a personal, limited, non-exclusive, non-transferable license to install and use TimerDash on devices you own or control, solely for your personal use and in accordance with these Terms. The App is licensed, not sold. Except for this limited license, we retain all right, title, and interest in and to the App, and all rights not expressly granted to you are reserved.
Intellectual Property Rights
TimerDash (including its code, design, text, graphics, sounds, icons, screenshots, feature images, logos, and other content) is owned by Bidit Mazumder and protected by copyright and other intellectual property laws, except for third-party materials used under license. Third-party licenses are available via the link labeled "Open-source licenses" in the App's About screen. Purchasing the App or using the App does not grant you any ownership rights in TimerDash. Except as allowed by these Terms or applicable law, you may not copy, reproduce, distribute, publicly display, or create derivative works from any part of the App. You may not use the name "TimerDash" or any logos, icons, or store listing assets (including screenshots and feature graphics) in a way that suggests endorsement or affiliation without permission.
Prohibited Activities
When using TimerDash, you agree not to:
1. Copy, reproduce, modify, distribute, sell, sublicense, lease, or share the App or any part of it, except as allowed by these Terms or applicable law.
2. Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent allowed by applicable law.
3. Remove, obscure, or alter any copyright or attribution notices in the App or its materials.
4. Bypass or circumvent purchase requirements or security/entitlement checks, or attempt to access premium features without a valid purchase.
5. Use the name "TimerDash," our logos, screenshots, feature graphics, or other TimerDash branding or store listing assets in a way that suggests endorsement or affiliation without permission.
6. Use the App for any unlawful, harmful, or abusive purpose, or in a way that disrupts or compromises the App's operation or security.
If you violate these rules, you may be in breach of these Terms, and we may suspend or terminate your license to use the App (see Termination below).
User Responsibilities
By using the TimerDash, you agree that:
1. Device and settings: You're responsible for maintaining your device and settings. TimerDash may not be able to play alarms or show notifications if your device is powered off or out of battery, has notifications disabled or restricted, is in Do Not Disturb mode, or uses battery optimization/power-saving modes that limit background activity. We also recommend not using TimerDash on rooted/jailbroken devices, which may reduce security and reliability and may affect Google Play–related features.
2. Internet for certain features: TimerDash is primarily an offline app, but an internet connection is required for Google Play purchases, entitlement checks to enable premium features, and in-app updates. If you're offline, those features may be unavailable.
3. Connectivity charges: You're responsible for any data, roaming, or internet access charges incurred when using TimerDash's online features. If you're not the account holder, make sure you're authorized to incur those charges.
Premium Features and In-App Purchases
TimerDash's basic features are free (including one Single mode timer/stopwatch, one Multi mode timer/stopwatch, and two timer presets). Pro features—such as running multiple timers/stopwatches at the same time—require a one-time "Lifetime Unlock" in-app purchase. This is a one-time purchase, not a subscription. Purchases are processed by Google Play, and your purchase is tied to your Google Play account. You're responsible for purchases made using your Google Play account. An internet connection is required to make purchases and to restore or verify your entitlement; if you're offline or if you're not signed in to the same Google Play account used for the purchase, premium features may be temporarily unavailable. Refunds are handled by Google Play and are subject to its refund policies and applicable law. If a purchase is refunded, reversed, or charged back, premium features may be disabled.
App Updates and Changes
We may update or change TimerDash from time to time to improve features, security, or performance. Some updates may be required to maintain compatibility with Android or Google Play–related features, such as purchases, entitlement verification, and in-app updates.
Termination of Use
You may stop using TimerDash at any time by uninstalling it from your devices. If you materially violate these Terms, we may suspend or terminate your license to use the App and remove premium access (if any). We may also discontinue TimerDash or any part of it at any time. Sections that by their nature should survive termination (including Intellectual Property Rights, Disclaimer of Warranty and Accuracy, Limitation of Liability, and Governing Law) will survive to the extent permitted by law.
Disclaimer of Warranty and Accuracy
We work hard to make TimerDash reliable, but the App is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee the App will operate without interruptions, delays, or errors, or that it will be compatible with every device or Android version. Some of the above may not apply to you where prohibited by law.
1. Timing Accuracy: We have put care into making TimerDash accurate, but we do not guarantee the precision of timers, stopwatches, alarms, or notifications, which may be affected by device settings and power-saving modes/features. Do not use TimerDash for safety-critical or high-risk purposes where timing failures could lead to injury, damage, or significant loss.
Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of, or inability to use, TimerDash, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total liability in the aggregate for any claim will not exceed the amount you paid (if any) for the App's "Lifetime Unlock." Some of the above limitations may not apply to you where prohibited by law; in such cases, our liability will be limited to the greatest extent permitted by law.
Changes to These Terms of Use
We may update these Terms from time to time. When we do, we will update the Effective Date at the top of this document. The most current version will be included in the latest version of the App. The updated Terms take effect when you install, update, or use a version of the App that includes them. By continuing to use the App after the update takes effect, you agree to the updated Terms. If you do not agree, you must stop using the App.
Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law rules. If you use TimerDash from outside India, these Terms still apply.
Entire Agreement
These Terms, together with our Privacy Policy, available via the link labeled "Privacy Policy" in the App's About screen, constitute the entire agreement between you and us regarding TimerDash and supersede any prior or contemporaneous agreements, representations, or communications about the App.
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
